By accessing or using ARTCASE ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
ARTCASE is a service operated by STUDIOT LABS LLC. By accessing or using ARTCASE at artcase.studio, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
Production: All cases are made-to-order. Please allow 1–3 business days for production.
Standard Shipping (Free): 4–7 business days after production.
Each case is custom-made on demand for your specific phone model (iPhone & Samsung Galaxy). Tough and Snap cases are printed by dye sublimation, which transfers the design into the case surface for a durable full-wrap finish. Clear cases are printed by UV printing directly onto the case, which holds sharper detail and deeper blacks. Because sublimation cannot reproduce a true black, very dark areas may appear slightly lighter on Tough and Snap cases. Available in Tough, Snap, and Clear styles with Glossy or Matte finishes.
Your Creative Rights: You retain all intellectual property rights you hold in the original creative elements you contribute, including your text prompts, reference images, and uploaded logos.
License to ARTCASE: By submitting a design for printing, you grant ARTCASE a non-exclusive, worldwide, royalty-free license to reproduce, modify, and display your design solely for the purpose of fulfilling your order.
AI-Generated Designs: Important Notice (2026): Designs generated solely by AI may not qualify for copyright protection under current U.S. law. The U.S. Copyright Office (USCO) requires a human author for copyright eligibility. You are solely responsible for determining the copyright status of any AI-generated design and for any legal consequences arising from its use.
Improvement of Services: We may use anonymized, aggregated usage data (including prompts and generated designs, stripped of all personal identifiers) to improve our AI models and platform. We will never sell your personal designs to third parties.
By using ARTCASE, you represent and warrant that:
- You own or have full legal rights to all content in your designs.
- Your designs do not infringe any copyright, trademark, patent, trade secret, or other IP rights of any third party.
- Your designs do not contain any unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene content.
- Your designs do not promote hate, violence, discrimination, or illegal activity.
- Your designs do not include explicit sexual content.
- Your designs do not use the name, image, or likeness of any person without their consent.
ARTCASE reserves the right, at its sole discretion, to refuse, cancel, or remove any design or order that violates these terms, without prior notice. Cancelled orders due to policy violations will receive a full refund.
You agree to defend, indemnify, and hold harmless ARTCASE, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; (iii) your violation of any third-party right, including any intellectual property or privacy right; or (iv) any claim that your content caused damage to a third party.
To the fullest extent permitted by applicable law, ARTCASE shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
ARTCASE makes no warranties regarding the accuracy, quality, or suitability of AI-generated designs for any particular purpose. AI generation is provided "as is" and results may vary.
ARTCASE may suspend or terminate your account at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, or in a court of competent jurisdiction in Wyoming.
